Brazil: Journalist Luiz Flavio Pinto Ordered to Pay US$15,000 for Defamation

In the case, Romulo Maionara Jr and Ronaldo Maionara accused Pinto of offending the honour and reputation of their father, a businessman who built the main media group in the region, Grupo Liberal for an article published in Jornal Pessoal, which Pinto runs, in 2005 which claimed that Romulo Maionara was involved in smuggling activities in the 1950s and 1970s. Pinto argued before the court that he was not the first to make these allegations, and presented copies of documents he believes prove that his allegations are general knowledge and also accurate. According to Pinto, such activities were commonplace in the isolated state of Para at that time.

Mexico: Community Broadcasters Criminally Charged

On 30 June 2009, Héctor Camero, Director of Radio Tierra y Libertad, a community radio station based in a poor neighbourhood in the northern city of Monterrey, was charged with the use and exploitation of a public resource (the airwaves) without a permit, which is punishable by up to twelve years’ imprisonment. Camero avoided being detained only because his lawyers launched a successful action for habeas corpus. Radio Tierra y Libertad has been providing public interest information to low income communities in Monterrey for seven years. The criminal prosecution was initiated by a formal request on behalf of the Ministry of the Interior.

Vietnam: Release Leading Human Rights Lawyer Le Cong Dinh Immediately and Unconditionally

Leading Vietnamese human rights lawyer Le Cong Dinh was detained by police on 13 June 2009 and has been held since then on charges of breaching Article 88 of the Penal Code of Vietnam for “distributing propaganda against Vietnam”. If convicted, Dinh faces up to twenty years in prison. ARTICLE 19 and Index on Censorship call on the Vietnamese authorities to free Dinh immediately and unconditionally, and to repeal Article 88 in full.

This symbolic act re-establishes an American legitimacy that had been forsaken in the eyes of the world.
